Vermont Tattoo Laws

Definitions

  • Director:A member of a director's board who controls the resources and expenditures.
  • Disciplinary action:An action taken by an admin law officer against the applicants on a finding of any illegal work or unprofessional conducts.
  • Tattooing practice:A permanent mark, design or coloration by the process of inculcation or pricking irremovable pigments on a human being skin.
  • Tattooist:A person practicing tattooing.

Functions of Director

  • Providing information about registration to the applicants.
  • Collecting fees.
  • Giving an explanation to registered tattooists and applicants in case of any appeal procedures and complaint procedures to the public.
  • Receiving registration application, renew, revoke, and reinstate registrations as told by an admin law officer.
  • After consultation with the commissioner of the health, the director can choose the rules related to infection controlling procedures and it is necessary to follow public health practices in the tattooing practice to protect the public.
  • Inspecting tattooing shops without any starting inspection fees.

Prohibitions

  • Tattooing practice allowed only after registration.
  • Age must be more than 18 years.
  • Tattooing a minor without written consent of the parent or guardian of the minor is illegal.

Advisor appointees

The secretary of state can choose or appoint a public health professional and medicine professional from registered tattooists (practicing for at least 3 years) or from the list provided by the health commissioner.

Registration:

  • For tattooing practice in this state, a person should register with the professional regulation office and a fee is also required.
  • Director decides the applicants practice location, qualification and service nature by observing the registrant's form.
  • For opening a shop, registration with the professional regulation office is necessary paying a required fee.
  • For overall cleanliness and sanitation of the shop, each shop shall have rights to assign a responsible license holder person.
  • Only registered shops are permitted to tattooing practice.

Unprofessional conduct

  • A registered operator or applicant shall not participate in any unprofessional conducts.
  • Unprofessional conduct means the following conduct and conduct set forth in section 129a of Title 3:
    1. Making using of dishonest or misleading ads.
    2. Intoxicated and drugs addicted tattooists can renders the professional services to a clients.
    3. Sexual harassment of a client.
    4. Tattooing the minors is against the provisions stated.
