CHAPTER 10 OFFENSES AGAINST PUBLIC HEALTH, SAFETY, WELFARE AND MORALS
PART 22 PUBLIC HEALTHY OFFENSES
76-10-2201. Unlawful body piercing and tattooing of a minor.
- As used in this section:
- Body piercing: The creation of an opening in the human body other than earlobe, for jewelry insertion or for other decoration purpose.
- Consent of minor's parent or legal guardian: The presence of a parent or legal guardian during the tattooing upon the minor.
- Minor:
- a person under the age of eighteen.
- is not married.
- who has not been declared emancipated by a court of law.
- Personal identification number: The valid driver's license number or other valid identification card, proof for age.
- A person is guilty of unlawful body piercing of minors if he performs or offers to perform a body piercing:
- upon minor
- without consent of the minor's parent or legal guardian
- for remuneration
- A person is not guilty of subsection 2 or 3 if he:
- had no actual knowledge of the person's age
- has maintained a personal identification number for minor before to operating an unlawful body piercing or tattooing.
- A person who violates Subsection 2 or 3 is guilty of a class C misdemeanor.
