Texas Tattoo Laws
Rule §229.401. General Provisions:
- These section gives information about the licensing and regulation of tattoo and certain body piercing studios and temporary locations.
- Without license permission, nobody should be allowed the operation, management or maintenance of a tattoo and certain body piercing studio and same rule is applied for temporary location also.
- There are some/minimum standards specified in this section in addition to the existing one, each tattoo and body piercing studios and temporary locations shall comply with it.

Rule §229.402. Definitions:
As used in these sections:
- Act: The Tattoo and Certain Body Piercing Studio Act, Texas Health and Safety Code.
- Antiseptic: A substance that destroys microorganisms.
- Artist: A person performing tattooing.
- Aseptic technique: Procedures used to prevent the direct transfer of fungi, bacteria, viruses or other microorganisms into human cell, tissues.
- Authorized agent: A department staff or a person licensed by the commissioner to enforce the Act.
- Body piercer: A person performing body piercing.
- Commissioner: Commissioner of the Texas Department of Health
- Tattoo/tattooing: The practice of creating a mark or indelible mark or design on the human body by inserting a pigments under the human skin by using needles or other related devices.
- Tattooist: A person who performs the tattooing operation.
Rule §229.403. Licensing Fees, Procedures
- License fees: Annual license procedure shall be required for each tattoo and body piercing studio except as indicated from the department and shall pay annual license fee.
- License forms: These forms may be available in Drug and Medical Devices Division, Texas Dept. of Health.
- License application: For each tattoo studio, an application shall be required. At starting, each tattoo studio or temporary location license application shall be signed and verified. Application shall include the following information:
- Name: The name of the person who conducting the tattoo studio or temporary location.
- Address: The detail information about the address of studio or temporary location that is to be licensed.
- Period (in days and hours) of operation of each tattoo studio or temporary location.
- Service description, provided by studio or temporary location.
- Issuance of license: Firstly department shall be determine the compliancy of studio or temporary location with the rules, zoning codes etc, then may issue a license to the person wishing to operate a studio or temporary location.
- Validity for tattoo studio shall be one year from the date of issuance. Validity for temporary location shall be specific and not more than seven days.
- Prominent place shall be decided for displaying a license in a studio.
- Renewal of license: only for studios.
- Renewal of license shall be required for each studio at each year.
- For renewal of a license, an application shall be needed. The department prescribed a form for an application purpose. So each license holder shall be fill this form for renewal of license.
- Amendment of license: If the owner name, ownership or place of the licensed studio is changed, then a license must be amended.
