§ 11-5-2 LEGISLATIVE FINDINGS AND INTENT.
- According to the Council, there is enough information to believe that injuries, infections and occasional disease may occur as the result of body art. Regulation of body art establishment and operation is needed to protect the health and welfare of residents.
- According to Council, For health and safety of the residents, regulation of body art establishment is needed.
§11-5-3 DEFINITIONS.
- ANTISEPTIC: A substance that inhibits the growth of microorganisms on living tissue.
- BODY ART: A style of art where the artist uses his or her own body as the medium for expression often shown in private or public performances.
- BODY ART ESTABLISHMENT: Any area or room to perform tattooing business.
- BODY PIERCING: A method of piercing the human skin.
- CLIENT: Anybody who inquires about or requests a body art procedure.
- CONTAMINATED WASTE: Infectious materials.
- COSMETIC TATTOOING: The practice of pigmentation in the skin using needles.
- DEPARTMENT: The Environmental Health Department of the city.
- DISINFECTION: Destroying the microorganisms.
- TATTOOING: A method by which ink is put under the skin to make a picture.
§11-5-4 BODY ART OPERATOR REQUIREMENTS AND PROFESSIONAL STANDARDS.
The following information needed for the form / file on the premises of a body art establishment and inspected by the department.
- The operator's full names and their duties.
- The relative information of the operators such as birth date, gender, home address and phone number (home and work).
- Photograph.
- The body art establishment name and operation hours.
- Owner's address and name.
- Description of complete body art performed.
§11-5-5 PERMITS.
- Permits shall be correctly and prominently displayed in the body art establishment and it shall be unaltered.
- It shall be illegal to perform body art without permission.
§11-5-6 GENERAL PROVISIONS.
- Smoking, eating, or drinking while doing body art is not allowed or prohibited at the place of body art and cleaning is being needed.
- Age of operator shall be at least eighteen years.
- A person, who is under the influence of alcohol or drugs, shall not be serviced by any operator.
- A high degree of personal cleanliness meets the hygienic practices and wear the clean cloth while performing the body arts, shall be maintained by the operators.
- A disposable medical gloves are needed while performing the body art by every operator.
§11-5-7 EXEMPTIONS.
Licensed physicians by the state of New Mexico who uses the body art procedures as part of patient treatment are granted exemption.
A person who pierce only the outer body and lobes of the ear using the proper procedures, are granted exemption.
