New Jersey Tattoo Laws

Be It Enacted by the Senate and General Assembly of the State of New Jersey:

  1. This act shall be known and may be mention as the "Tattooing and Body Piercing Practice Act".

  2. Following definitions are used in this act are:

    • BOARD: It means State Board of Medical Examiners.

    • BOARD PIERCING: It means making a hole in a human body for jewelry insertion or other decoration purposes.

    • BODY PIERCING ARTIST: It means a person having license to practice body piercing according to the act.

    • COMMITTEE: It means the Tattooing and Body Piercing Advisory Committee.

    • TATTOOING: A method used to produce an indelible mark or figure in the skin.

    • TATTOO ARTIST: A licensed person practicing tattooing pursuant to provisions of this act.

  3. "Tattooing and Body Piercing Advisory Committee" is created within the DCA (Division of Consumer Affairs) in the DLPS (Dept. of Law and Public Safety), under the SBME. The committee shall include five members, who are from this state only. This is like: one tattoo artist, one body piercing artist, one public member to represent consumer interest and two physicians having tattooing practice license pursuant to the act. Every tattoo artist should have at least four years experience in delivery of tattooing services.

  4. Committee can conduct an annual election for chairperson from among its members.

  5. Tattooing and body piercing of minors: Without having written permission of the minor's parents or guardian, body piercing of the minor (under the age of 18) is illegal.
