45-5-623. Unlawful transactions with children

  1. As mentioned in the in 16-6-305, a person supposed to be guilty by unlawful transactions with children, if that person is knowingly:

    1. gives or sells explosives to a child, mostly minor and if he is not authorized under appropriate city ordinances;

    2. gives or sells intoxicating substances other than alcoholic beverages to minor or child;

    3. gives or sells alcoholic beverage to a person, who is under 21 years of age;

    4. tattoos or provides a body piercing on a child, who is under the age of majority in the absence of and without the consent of the child's parent or guardian.

    In this subsection, 'tattoo' and 'body piercing' have the meaning provided as per section 50-48-102. When it is found and verified that the identity of a parent or guardian is not proper, then also it is not an excuse for violation of this subsection.

  2. Such person who is convicted of the offense of unlawful transactions with children, have to pay amount not to exceed $500 as a fine or be imprisoned in the county jail for any term not to exceed 6 months, or both of these. A person convicted of a second offense of unlawful transactions with children, have to pay amount not to exceed $1,000 as fine or be imprisoned in the county jail for any term not to exceed 6 months, or both of it.
