211.760 Tattooing of humans by nonmedical personnel for remuneration, Registration, Administrative regulations, Compliance checks and Exception Hearings.

Without registering with the local health department in the district or county in which the person is to perform tattooing, no one is allowed to engage or carry on any business of tattooing of humans by nonmedical personnel for remuneration within the Commonwealth of Kentucky.

This registrations is valid for 1 year. Applicant's fee for registration is 20$, have to pay to the local or district health department.

The Cabinet for Health Services promulgate administrative regulates :

  1. Cleanliness of the tattooing business place

  2. Sterilization of apparatus used in tattooing

  3. Preventive procedures for disease spread or infection during tattooing

  4. Procedures which prevent tattooing minors without the consent of their parents or guardians

  5. Other administrative regulations, which are helpful and necessary to protect public health or administer the requirements for the program of this section.

Any of the local or district health departments or the representatives of the cabinet may visit any time during business hours the tattooing facilities in order to make sure it is meeting the requirements of this section.

District health departments or the representatives of local shall visit each and every tattooing facility registered in their district or county at lest twice in a year.

This section shall not apply to a person, who is engaged in the application of permanent makeup. Under this section any administrative hearing conducted shall be conducted in accordance with KRS Chapter 13B.
