License required to perform certain activities or engage in certain advertising; exceptions; penalty; action to enjoin unauthorized activities; cease and desist orders.
- A permanent color technician and tattoo artist are not allowed to tattoo or display a symbol or use it for advertising and tattoo design, unless and until that artist holds board issued license for it. No one allowed to practice body piercing, display a specific sign or use it in advertising or appeared to be in the business of body piercing unless and until that artist holds board issued license for it.
This act is not a prevention or affecting the use of tattooing, any permanent color technology or body piercing by individual performing tattooing, a licensed dentist, person under the control and supervision of a licensed dentist, physician, person under the control and supervision of physician, permanent color technology and or body piercing on individual body or any other person, who is permitted to use electrolysis or tattooing by law.
- But the violation of subsection (a) by any one is a class A nonperson misdemeanor.

Definitions : Meaning of the terms used in above section
- Board : It means the Kansas state board of cosmetology.
- Licensed permanent color technician and tattoo artist : - A person licensed and allowed as per the act for tattooing or permanent color technology, or both of them.
- Permanent color technician and tattoo artist : - A person who practices permanent color technology or tattooing, or both.
- Body piercing - It means puncturing the skin of any person using needles or any other instruments designed specifically to puncture the skin and for the purpose of inserting removable jewelry or other objects through the human body, the external part of the human earlobe not included in this definition. This act does not authorize a licensed body piercer to embed or implant foreign objects into the human body or to involve in the practice of medicine and surgery.
- Physician - A person, who is licensed to practice medicine and surgery by the state board of healing arts.
- Tattoo - It means the indelible figure, mark or symbolic design introduced by insertion of nontoxic pigments or dyes under or into the subcutaneous portion of the skin upon the body of a live human being.
- Tattooing- It is the process in which the skin is marked or colored by insertion of nontoxic pigments or dyes under or into the subcutaneous portion of the skin in order to make indelible marks.
- Tattoo facility - It means any place, where tattooing is practiced or the business of tattooing is conducted.
