Section 3: Minimum Requirements for Body Art Establishments
- 3-301 The body art establishment should have a person(s) in charge, who will be responsible for the operation all times.
- 3-302 The information on employee of a body art establishment shall be on file and available for inspection by the Department as follows:
- Full name (legal)
- Residential address
- Residential phone number
- Shall have a written proof about the employees handling sharps, infectious waste have completed or declined, the hepatitis B vaccination series offered to them. As it is the offering as pre employment requirement and comply with 2-201(b).
- 3-303 The person in charge should have access to information and on the premises for review by the Department as follows:
- Agreement or contract for Infectious/Regulated Waste disposal and or sharps disposal.
- Spore test log and test results
- Records of the clients
- Information on sterilization equipment about it's manufacturer
- Written procedures about infection and exposure control
Section 4: Client Records
- 4-401. In charge person shall have access and maintain records of the clients on the premise for at least 3 years. As well as the Department shall have client records available to review by them.
- 4-402 The information shall be documented and it has to be used by the body artist to see the client's suitability for receiving a body art. In order to give any assurance of proper healing of a client during or after the body art procedure, he/she shall disclose if he/she has had any of the following:
- Allergies or adverse reactions to latex, pigments, soaps, metals, dyes and disinfectants etc.
- Information which help in the client's healing process evaluation to the body artist.
- Diabetes and or Hemophilia
- Medications that thin the blood and/or interfere with blood clotting or treatment with anticoagulants.
- Skin lesions or skin diseases
- 4-403 Client consent form for all procedures shall include the following:
- Client - Name, current address and phone number
- Date of the procedure
- The body art type and location
- Documentation that instructs about risks, outcome and aftercare both written and verbal, which were given to the client like:
- Name, Address, and phone number of the body artist who performed the procedure
- Direction about consulting a physician after sign of infection, allergies and expected duration of healing.
- Description related to caring the body art procedure site.
- Body art should be considered permanent and explanation about it.
- List of any possible side effects from the procedure
