Title for reference : tattoo parlors; minors
It is an act repealing section 13-3721, which means Arizona Revised Statutes; Amending Title 13, Chapter 37, Arizona Revised Statutes, by adding a new section 13-3721; relating to tattoo parlors.
Legislature of the State of Arizona defined crimes by the :
Section 1. Repeal
Section 13-3721 , Arizona Revised Statutes, is repealed.
Sec. 2. Title 13, chapter 37, Arizona Revised Statutes, is amended and added a new section 13-3721, as follows:
- 13-3721. Tattoos, brands, scarifications and piercings; minors; violation; classification; anesthesia; defense
Definitions:
- It is unlawful to brand, scarify, tattoo or pierce the under fourteen years of persns body intentionally. But it do not include and apply to ear piercing or procedures in the health care provider, who have license as per the title 32.
- In the absence of a person's parent or legal guardian, it is unlawful to tattoo a person, who is under fourteen, fifteen, sixteen, seventeen or eighteen years age.
- Use of a needle that is not sterilized or autoclavedit or ink used more than once for a person who tattoos or pierces the body of other person is unlawful.
- Person who do not have license as per the title 32 to administer anesthesia during the procedure involving the branding, scarifying, tattooing or piercing of the body of other person is unlawful.
- It is defense to a prosecution for a violation of subsection 1 or 2 that if the requested person's age identification is false.
- One who violates this section is guilty of a class 1 misdemeanor.
- In this section:
Tattoo - means any indelible design, symbol, letter, scroll, figure, any other mark, which is placed on or under the skin with colors or ink with use of needles or another instruments and it's not able to remove it without a surgical procedure.
Main purpose of these laws is to protect the health of the public. Thease laws establish some standards about prevention of diseases due to tattooing and branding. These rules are applied and interpreted in order to protect the public health.
