New York State's Marriage Ceremony Officiating Requirements
Identification Requirement in New York: You should provide current photo identification such as your driving license, birth certificate and passport.
Residency Requirement: Not necessary to be resident of New York.
If Previously Married: In such case, you need to show certified copy of previous marriage divorce decree etc.
Wait Period in New York: 24 hours waiting period.
Marriage Fees Required in New York: You have to pay $40 to $50 for getting married in New York.
Any Other Test Required: No tests.
Proxy Marriages: Not allowed.
Cousin Marriages: Allowed.
Common Law Marriage Options: None.
Marriage for Same-Sex Option: Not allowed in New York.
Under 18 Marriages:
For individuals under the age of 16 or 17 years, a completed consent form from their parent is must.
For individuals under the age of 14 or 15 years, a written consent from their both parents and a Supreme Court Judge of local family court is must.
Marriage under 14 years age not allowed in New York.
Consent from your parents or your legal guardians must be taken before any clerk or authorized officials.
If there is problem such as they are out of state, a notarized affidavit is allowed or acceptable but the condition is it is with a certificate of authentication (at the time of consent filed)
Marriage Ceremony Officiants: Only authorized, officially ordained members are allowed to perform a wedding ceremony such as a mayor, city clerk, appointed marriage officer, justice or judges etc.
Witnesses:
At least one witness (18 years old or more) is required for a marriage ceremony.
60 days validity period for getting marriage license.
