Access to Adoption Records

  • Non-Identifying Information: To obtain non identifying information, a person must complete 18 years of age or over.
  • Confidential Intermediary: Adaptive parents, birth parents, birth siblings (19 age or older) and adapted person (age eighteen or older) can have this service.

    Birth Certificate (Original): A petition to the court is must to obtain a certificate by adoptee.

Consents

  • Consent to an adoption shall be done by:
    Statute: - § 1-22-109
    • Both Parents if living
    • Guardians (legal)
    • A mother and putative father if his name is known
    • Legal custodian of child, or
    • An Executive Head of Agency to which the child has been relinquished for adoption.

  • Age Requirement for consideration of Adoptee Consent:
    Statute: - § 1-22-109
    A person having age 14 years or older should consent to the adoption.

  • When Consent is not required:
    Statute: - § 1-22-110
    • If the parents fails to answer to the notice or unable to appear at the hearing;
    • On termination of parental rights;
    • The parents willfully abandoned the child or been adjudged guilty of child abuse or neglect it;
    • If unable to complete the support obligations;

  • Parental Consent can be executed:
    Statute: - § 1-22-109
    • At any time after the birth of child;
    • A document including a written custody relinquishment and consent;
