Adoption Records Access

  • Non-Identifying Information : Adopted person, birth parents, adoptive parents, legal guardians and adopted adult may obtain the non identifying information.

  • Adoption Registry : Adopted adults and birth siblings (completed 21 years of age or older), birth parents may use this adoption registry.

    Birth Certificate (Original): A petition to the court in which the adoption was finalized is must for adoptee.

Consents

  • Consent to an adoption shall be done by:
    Statute: - §- § 78-30-4.14; 78-30-4.21
    • The mother
    • Biological father
    • The agency which places the child for adoption
    • A minor parents

  • When Consent is not required :
    Statute: - §- § 78-30-4.17; 78-30-4.23
    • On termination of parental rights by court.

  • Parental Consent can be executed :
    Statute: - § 78-30-4.19
    • A twenty four hours period is required after the birth of child, for consent execution for birth mother.
    • Any other person may made consent at any time.
