Laws for Infant safe Haven

• Age Requirements :
  Statute: Fam. Code - § 262.302

  The child must be sixty days old or younger.

• The following may relinquish the Infant :
  Statute: Fam. Code - § 262.302
  • Parent of that Infant.

• The following may receive the Infant :
  Statute: Fam. Code - § 262.301
  • Hospital
  • An authorized child-placing agency
  • Emergency Medical Services Provider

• Safe Haven Provider Responsibilities :
  Statute: Fam. Code - §- § 262.302; 262.303
  • They can take any action to protect the child and his health.
  • Notify the Department.
  • Provide the voluntary disclosure form of medical information to the parents.

• Parental Rights :
  Statute: Fam. Code - § 262.303
  • Custody of the child should assumed by the Dept. of Protective and Services.
