Adopting Parties

  • Followings may place a child for adoption:
    Statute: - § 36-1-108
    • Parents.
    • The Department.
    • An agency having license to place the child.
    • An authorized or licensed clinical social worker.

  • Followings may adopt a child :
    Statute: - § 36-1-115
    • Any resident (at least 6 months) person over eighteen years of age may adopt a child.
    • First preference given to the foster parents on adopting their foster child.
    • Joint petition is must for spouses.

Putative Fathers

Putative Father Registry is required in Tennessee State.

  • What are the registry requirements to receive notice?
    Statute: - §- § 36-2-318(e)(3); 36-2-318(j)
    • A putative father can register a parental interest before the birth of child or within thirty days after the birth of child.
    • A putative father has a rights to file a parentage complaint within thirty days from the day of receipt of adoption proceedings notice.

  • Registry Information :
    Statute: - § 36-2-318(e)
    • Name, address information of the putative father, birth mother and child.
    • Name and address information about the person who has filed the notice of intent to claim the paternity.

  • Paternity Revocation (of claim):
    Statute: - § 36-2-318(g)
    • A putative father may revoke at any time by submitting the written statement.

  • Registry Information Access :
    Statute: - § 32-2-318(h)
    • As evidence, others can use the notice of intent to claim paternity in which the parents of a child may be relevant.
