Adopting Parties

• Followings may place a child for adoption:
  Statute: - § 26-6-8
  • The child's parents and legal guardians
  • An authorized child placing agency
  • Social Services Departments

• Followings may adopt a child :
  Statute: - § 25-6-2; 25-6-3
  • Any person (must be 10 years older or more than the adoptee).
  • Any married person having the consent of his/her spouse.

Putative Fathers

South Dakota State does not have a Putative Father Registry.

• What are the registry requirements to receive notice?
  Statute: - §- § 25-6-1.1; 25-6-1
  Within sixty days of the birth of child:
  • The putative father should openly acknowledge the child as his own.
  • Giving his name to the child and placing it on birth certificate.
