Laws for Infant safe Haven

  • Age Requirements :
    Statute: - § 23-13.1-3

    A child must be thirty days old or younger

  • The following may relinquish the Infant :
    Statute: - § 23-13.1-4
    • Parents and a person directing by the parents may relinquish the infant.

  • Safe Haven Provider Responsibilities :
    Statute: - § 23-13.1-3
    • They should provide the required medical care to the child.
    • They should provide information to the parents about legal relinquishment.
    • They must notify the department.

  • The following may receive the Infant :
    Statute: - § 23-13.1-3
    • Hospital, fire station, police station and medical emergency facility may receive the infant.

  • Parental Rights :
    Statute: - § 23-13.1-5
    • A petition is must for termination of parental rights. This petition must be filed in ninety days unless the parent has asserted its claim.
    • A temporary custody of child should be taken by the department.
