Adopting Parties

  • Followings may place a child for adoption:
    Statute: - § 109.309
    • Parents
    • A child's relatives or other
    • A licensed child-placing agency

  • Followings may adopt a child :
    Statute: - § 109.309
    • Any Oregon resident.

Putative Fathers

Oregon State does not have a Putative Father Registry.

  • What are the registry requirements to receive notice?
    Statute: - § 109.096
    • The putative father needs to file notice before the custody of a person for adoption purpose.
    • Before paternity establishment, notice of adoption proceedings will be entitled to the putative father, iff petitioner knows that:
      • The child resided with him at any time since the birth of child (child is under the age of 60 days), when the proceeding is started.
      • He always tried to give a support of the child during the period since the birth of child (if the child is less than one year old), when the proceedings is started.
      • He should file with the Center for Health Statistics of the Health Division of the Department of Human Services.

  • Registry Information :
    Statute: - § 109.225(1)
    • A notice which is sent to the CHS, DHS shall include:
      • Child's full name and address
      • If the child is not yet born, then probable birth date and place
      • Information about child's alleged parents such as names and addresses

  • Paternity Revocation (of claim):
    Statute: - § 109.070(2)

    A voluntary acknowledgment of paternity party may cancel the acknowledgment:

    • Within the sixty days after filing.
    • In situation like any fraud, mistakes or duress.
    • A person can not rescind the voluntary acknowledgment after the one year, unless the genetic testing results exclude him as a possible father of child.

  • Registry Information Access :
    Statute: - § 109.225(2)
    • Registry information may access the person whose name is in the notice.
    • Any legal person or agency.
    • Parties to adoption.
