Consents
- Consent to an adoption shall be done by:
Statute: Title 10, - § 7503-2.1
- Parents
- A legal guardian
- Minor parents or guardians
- Age Requirement for consideration of Adoptee Consent :
Statute: Title 10, - § 7503-2.1
A child of age 14 years or older must consent to the adoption.
- When Consent is not required :
Statute: Title 10, - § 7505-4.2
- If parental rights are terminated.
- If parents are unable to support the child or failed to support him (for 12 months).
- On failure of paternity acknowledgment by putative father.
- If parent has some problems like mental illness, any deficiency etc.
- Parental Consent can be executed :
Statute: Title 10, - §- § 7503-2.2; 7503-2.3
- Before birth of child, the parents can not execute consent.
- A putative father may be allowed to consent at any time (before or after the birth of child).
- For a permanent relinquishment execution, court authorization is must in written statement.
- Consent Revocation:
Statute: Title 10, - §- § 7503-2.7; 7503-2.6
- Consent is revocable for any reason for fifteen days, if it is an extra judicial.
