Laws for Infant safe Haven

• Age Requirements :
  Statute: - § 27-20-02

  A child must be a one year old or younger.

• The following may relinquish the Infant :
  Statute: - § 50-25.1-15
  • Parents and parent's agent may relinquish the infant.

• Safe Haven Provider's Responsibilities :
  Statute: - § 50-25.1-15
  • They can obtain the parents information by request and provide it to the parents also.
  • They must notify the Department within 24 hours.

• The following may receive the Infant :
  Statute: - § 50-25.1-15
  • A hospital holding a license may receive the infant.

• Parental Rights :
  Statute: - § 50-25.1-15
  • Parents are allowed to participate in court actions, iff the parental rights have not been finished.
