Adopting Parties

  • Followings may place a child for adoption:
    Statute: Soc. Serv. - § 374
    • A parent.
    • A licensed agency
    • A legal guardian
    • Second decree relatives

  • Followings may adopt a child :
    Statute: Dom. Rel. - § 110
    • Any adult person
    • A legally separated married person (adult)
    • A husband and wife together

Putative Fathers

New York State requires a Putative Father Registry.

  • What are the registry requirements to receive notice?
    Statute: Soc. Serv. Law - § 372-c(1)
    • At any time (before or after the birth of child), a putative father may file an intent to claim paternity.

  • Registry Information :
    Statute: Soc. Serv. Law - § 372-c(1)
    • Father's name and address that is adjudicated by the court.
    • Name and address of the person who has filed.

  • Paternity Revocation (of claim):
    Statute: Soc. Serv. Law - § 372-c(3)
    • At any time, the putative father can revoke the notice of intent to claim paternity.

  • Registry Information Access :
    Statute: Soc. Serv. Law - § 372-c(5)
    • A licensed agency can access the registry information.
    • If a person has good reason to access this information.
