Adopting Parties
- Followings may place a child for adoption:
Statute: Soc. Serv. - § 374- A parent.
- A licensed agency
- A legal guardian
- Second decree relatives
- Followings may adopt a child :
Statute: Dom. Rel. - § 110- Any adult person
- A legally separated married person (adult)
- A husband and wife together
Putative Fathers
New York State requires a Putative Father Registry.
- What are the registry requirements to receive notice?
Statute: Soc. Serv. Law - § 372-c(1)- At any time (before or after the birth of child), a putative father may file an intent to claim paternity.
- Registry Information :
Statute: Soc. Serv. Law - § 372-c(1)- Father's name and address that is adjudicated by the court.
- Name and address of the person who has filed.
- Paternity Revocation (of claim):
Statute: Soc. Serv. Law - § 372-c(3)- At any time, the putative father can revoke the notice of intent to claim paternity.
- Registry Information Access :
Statute: Soc. Serv. Law - § 372-c(5)- A licensed agency can access the registry information.
- If a person has good reason to access this information.
