Laws for Infant safe Haven

  • Age Requirements :
    Statute: - § 24-22-3

    A child must be ninety days old or younger.

  • The following may relinquish the Infant :
    Statute: - § 24-22-3
    • Anybody may relinquish the infant.

  • Safe Haven Provider's Responsibilities :
    Statute: - §- § 24-22-3; 24-22-4
    • They must take any necessary medical care of the infant and also provide it to the infant.
    • They can obtain the required information about the birth parents and medical history.
    • They can notify the Department within the 24 hours.

  • The following may receive the Infant :
    Statute: - § 24-22-3
    • Employees of a licensed hospital
    • Health care clinic

  • Parental Rights :
    Statute: - §- § 24-22-5; 24-22-7
    • Thirty days are available to seek reunification with the child for parents.
    • The custody of the child has taken by the Department.
    • Special placement preferences are provided for Indian child.
