Adoption Records Access
- Non-Identifying Information: Adopted parents and adopted adults can obtain the non identifying information.
- Identifying Information: Identifying Information: Birth parents can obtain the identifying information by filing the consent with the Dept. of State Social Services.
- Birth Certificate (Original): To obtain copy of birth certificate, medical history etc., a person must be adopted on or after September 1, 1988.
If a person was adopted before 1st Sep. 1988, he needs to request the court with the consent from both the parents.
Consents
- Consent to an adoption shall be done by:
Statute: - §- § 43-104; 43-105- Any court having legal custody of the child
- The department or an authorized agency
- A legal guardian
- Parents
- Age Requirement for consideration of Adoptee Consent:
Statute: - § 43-104- A child of 14 years age or older must consent to the adoption.
- When Consent is not required:
Statute: - §- § 43-104; 43-105- The parent ha surrender the child for adoption
- The parent has abandoned or abused the child.
- On termination of parental rights.
- The parent has failed to give consent
- Parental Consent can be executed:
Statute: - § 43-104- At least 48 hours are required after the child's birth to execute the consent.
