Adoption Records Access

  • Non-Identifying Information: Adopted adults and adoptive parents can obtain non identifying information.

  • Identifying Information : Identifying information can be obtained through the agency.
    An adopted adult may request information about the birth parents and agency will give it to them with consent from the birth parents.

  • Birth Certificate (Original): To obtain certificate, an adoptee must requests the court in which the adoption was finalized.

    Consents

    • Consent to an adoption shall be done by:
      Statute: - § 453.030
      • The birth mother
      • Adoptive parents
      • The presumed father who established the paternity.

    • Age Requirement for consideration of Adoptee Consent :
      Statute: - § 453.030
      • A child of age 14 or older must consent to the adoption; iff the court finds the child is mentally good.

    • When Consent is not required :
      Statute: - § 453.040
      • A parent have been terminated his parental rights
      • An incompetent parent
      • A parent has failed to contact or support the child
      • A parent has abused or abandoned the child

    • Parental Consent can be executed :
      Statute: - § 453.030
      • Consent execution requires 48 hours after the birth of the child. Petition for adoption is must, and it can be filed at any time.
