About adoption consent

  • For whom it is must to consent to adoption : Statute : - § 93-17-5

    • Both or single parent (if one of the living).
    • Two adult kin from which one of them is in possession of the child, if both the parents are deceased.
    • Person who like to take the custody of child.
    • Country department's agent.

  • Age required of an adoptee to consent of adoptee: Statute: - § 93-17-5

    A child of age 14 or more than it must consent to the adoption.

  • No need of parental consent: Statute: - § 93-17-5; 93-17-7

    Parental consent has been not needed when parent has:

    • Discarded or injured the child.
    • Unable to take responsibility of child.
    • Parents may suffer from medical or emotional sickness or chemical dependency.
    • Finished parental rights.
    • Unless father of child shown within 30 days of the child's birth a promise to parenthood, if he born out of marriage.
