Adoption expenses regulation

Expenses allowed for birth parent : Statute: § 259.55 Subd. 1

  • Legal fees, medical expenses
  • Travel expenses, foods, and lodging
  • Counseling
  • Adoption services provided by an agency
  • Living expenses

Expenses not allowed for birth parent :Statute: §259.55 Subd. 1

  • Does not include gifts, educational expenses, lost wages, etc.
  • Expenses for living shall not extend beyond six weeks after delivery.

Expenses allowed for arranging adoption :Statute: §259.55 Subd. 3(b)

If the person is engaged in any placement activity may not give money or anything of value to the birth parent.

Expenses allowed for relinquishing child : Statute: § 259.55 Subd. 2, 3

  • To give or accept payment for the placement of a child for adoption it is unlawful
  • A birth parent refuses to consent or withdraw consent to adoption when reimbursement for expenses is not allowed.
  • Payment shall not be possible upon placement, consent or cooperation in the completion of an adoption.

Fees allowed for charges by department or agency : Statute: Statute: § 317A.907 Subd. 6

  • A licensed agency may receive payment for.
  • Expenses related to adoptive counseling.
  • Supervision of children before legal adoption is complete..
