About adoption consent

  • For whom it is must to consent to adoption : Statute : Fam. Law - § 5-311

    • If terminated the parental rights then head of the agency that has been awarded guardianship.
    • The real mother and father

  • Age required of an adoptee to consent: Statute: Fam. Law - § 5-311

    • To the consent of adoption a child may be of age 10 years or more than that.

  • No need of parental consent: Statute: Fam. Law - § 5-312

    • If the parent has failed the source of contact with the child or to support them.
    • The rights of parents have been finished
    • The child has been out of the parent's custody for 1 year, and is in the custody of a child-placing agency.
    • The child has been out of the parent's custody for 1 year, and has formed a significant attachment to the petitioner.
    • The parent has unable to contact with the child or to support the child.

Advertising used and facilitators in adoptive placements

  • Intermediaries or facilitators use : Statute: Fam. Law - § 5-327(a)

    This subsection does not prohibit the payment, by any interested person, of reasonable and customary charges or fees for hospital or medical or legal services.

    A single person, an agency, institution who gives any service connection with a placement for adoption, may not charge or receive from natural parents or behalf of the individual to be adopted.
