Adoption expenses regulation

Expenses allowed for birth parent : Statute : Ch. Code art. 1200

  • Mother offered with living expenses.
  • Hospital expenses, medical and foster care expenses of the child.
  • The cost of medical and hospital offered to mother.

Expenses not allowed for birth parent : Statute : Ch. Code art. 1200

  • Mother's living expenses may not extend beyond 45 days after the birth.
  • Reduction in the amount if a court determines that an expense is unreasonable.

Expenses allowed for adoption arrangment : Statute: La. R.S. - § 14:286

  • For arranging adoption only licensed nonprofit adoption agencies may charge fees.

Expenses allowed for child relinquishment : Statute: Ch. Code art. 1200; La. R.S. - § 14:286

  • It is unlawful to sell or to surrender a child for money or any another earnings.
  • Payment of expenses may not made contingent in case of placement of child for adoption.

Fees allowed for charges by agency or department : Statute: Ch. Code art. 1200

  • Reasonable costs or expenses are expected from adoptive parents.
  • Legal fees
  • Home studies
  • Counseling
  • Training
  • Administrative costs.

Expenses accounting court requirment : Statute: Ch. Code art. 1200, 1201

  • The petition must contain filed fees.
  • The statute containing a form of affidavit.
  • Each petition for an agency adoption shall be accompanied by an affidavit of accounting of all fees and charges paid.
