  • For whom it is must to consent to adoption : Statute : Ch. Code Art. 1193

    • The mother of a child.

    • The biological father who has established paternity.
    • The custodial agency that placed the child for adoption.

  • Age required of an adoptee to consent : Statute:

    • Not addressed.

  • No need of parental consent: Statute: Ch. Code Art. 1245

    • The consent of a parent must have to dispense with, when parent with custody is married to the petitioner and has failed to support, communicate or visit with the child without any cause for 6 months. This causes in interfamily adoption.

  • Execution of consent: Statute: Ch. Code Art. 1121; 1122

    • Before a notary and with two witnesses, the consent must be executed.
    • In the process of private adopting, parents need to represents his or her own attorney.
    • Order to this or law, the parents must need to go under counseling sessions, or consulting with attorney and be informed about Voluntary Registration Law.
    • Any parent need to give permission in open court.
      • Parents need to appear personally.
      • The parents freely consent to or give predication to the adoption.

  • Consent execution is must: Statute: - § 63.082

    • In the presence of 2 witnesses, acknowledged by a notary public, parents may execute consent in case of direct placements.
    • In the agency adoption, consent is by affidavit and only from an authorized representative.

    Advertising used and facilitators in adoptive placements

    • Advertisement used : Statute: Rev. Stat. - § 46:1425(A)

      For any person other than a licensed child-placing agency it shall be unlawful or a Louisiana-based crisis pregnancy center to advertise through print or electronic media that it will adopt children or assist in the adoption of children.

    • Intermediaries or facilitators use : Statutes : Rev. Stat. - § 14:286(B)-(C)

      • The procurement for the payment or receipt of anything of value or assistance in the procurement of a party to an act of voluntary surrender of a child for adoption is prohibited.
      • No requester, agency, attorney or other intermediary shall make any payment in connection with an adoptive placement.
