State haven laws for Infants

    • Child should be of age 72 hours minimum or may be younger than this.

  • Who may relinquish the infant : Statute: - §- § 216B.190; 405.075
    • Parent(s) of the child.
    • Any one.

  • Who may receive the infant : Statute: - §- § 216B.190; 405.075
    • Any fire fighters.
    • Any one from the emergency medical services providers.
    • Any police officer.

  • Responsibilities of the safe haven provider : Statute: - § 216B.190
    • Should notify about it to the 'Department of Community Based Services'.
    • Should provide all required medical care to the child.
    • Try to collect the medical and health related information.

  • Immunity for provider : Statute: - § 216B.190 Yes.

  • Protection for relinquishing parent : Statute: - §- § 216B.190; 620.350
    • The mother should provide her identity proof and name and address to person accepting her child.
    • Mother shall not be prosecuted for cruelty to a child and shall not contributed to the deprivation of child, or abandonment, and the child is not more than one week old.

  • Effect on the parental rights : Statute: - § 620.350
    • Petition about terminating the parental rights can be filed after 30 days.
    • Before finalizing the termination, Parent(s) can also file any claim related to the parental rights.
    • Child may be placed in a foster family.
