Putative fathers

Yes, this state have a Putative Father Registry.

Registry requirements to receive notice : Statute: - §§ 63.054; 39.803

  • The court will conduct an inquiry, if identity or location of a parent is not exactly known and petition for terminating the rights is filed.
  • The putative father can file notarized claim of paternity form with the Putative Father Registry.
  • If prospective parent is identified, may complete sworn affidavit of parenthood, which must be filed prior or after the adjudicatory hearing in the termination proceeding.
  • The form may be filed or the filing of a petition for termination of rights at any time prior to the child's birth.

Information in the registry or claim : Statute: - § 63.054

  • Date, place of the child's birth, and name or known and estimated date of birth
  • Address, date of birth, name, and physical description of the putative mother and father
  • Location of conception, date and place

Revocation of claim to paternity : Statute: - § 63.054

  • On receving the revocation by the Registry, the claim of paternity is void.
  • At any time prior to the child birth, putative father can execute the written notarized revocation of the claim of paternity.

Who may access to registry information : Statute: - § 63.054

Registry information is confidential and on request released only to followings:

  • A petitioner and a court in case of adoption proceeding or termination of parental rights.
