State haven laws for Infants

  • Infant age : Statute: Ch. 325, - § 2/10
    • A 72 hours child or younger child.

  • Who may relinquish the infant : Statute: Ch. 325, - § 2/15
    • The natural parent(s).

  • Who may receive the infant : Statute: Ch. 325, - § 2/20
    • Police stations
    • Fire station
    • Emergency department of any hospital.
    • Any hospital

  • Responsibilities of the safe haven provider : Statute: Ch. 325, - §§ 2/20; 2/25
    • In case the child is relinquished at any of the places like the emergency medical facility, fire station, police station, they should avail the transportation for that child to the nearby child clinic.
    • In case if the natural parents came back in 72 hours for a child, they should get the right information about the exact location of a child.
    • These organizations who accept the child have to give all the required emergency and health care.
    • Any of the hospital accepting a child have to check for the child abusing or neglection.

  • Immunity for provider : Statute: Ch. 325, - § 2/27 Yes.

  • Protection for relinquishing parent : Statute: Ch. 325, - §§ 2/25; 2/30
    • In case if abusing is not occurred then the natural parents can be anonymous.
    • Nothing like a child protective or a criminal investigation is necessary, just because of the relinquishment of the newborn baby.
    • This law doesn't support abandonment or an endangerment of the life or the health of any child.

  • Effect on the parental rights : Statute: Ch. 325, - §§ 2/15; 2/50; 2/55
    • Termination of the parental rights will initiate as soon as 60 days are over after relinquishment of a child.
    • It is acceptable and allowed by law to petition for the returning a custody of a child before termination of parental rights by parents.
    • In case of a failure to file claim before the exact termination of parental rights by the parents, then no further future action can be allowed to them.
