About adoption consent
- Who have to consent : Statute: 750 ILCS 50/8(b)
- Any legal guardian of the child.
- Person or any organization with legal custody
- A mother
- A father, in case married to child's mother or established paternity
- Age required of an adoptee to consent : Statute: 750 ILCS 50/12
- Any child of age 14 years.
- The court can also waive consent in case it found the child is in need of any mental treatment.
- No need of parental consent: Statute: 750 ILCS 50/8(a)
- If parents found unfit
- If parent waived parental rights
- Consent execution is must: Statute: 750 ILCS 50/10
- The forms used are coming under the laws by the statute.
- If any consent towards any agency is written, it can be accepted by the agency head.
- In case of placing a child directly, until the court waives the appearance consent is acknowledged in court.
- Consent revocation : Statute: 750 ILCS 50/11; 750 ILCS 50/9
- It is also possible a father revokes the consent in the 72 hours just after the child birth.
- Until found as fraud, consents are actually irrevocable.
