State haven laws for Infants

  • Infant age : Statute : - § [39-8203]

    • 30 days or younger than that.

    • Any hospital
    • A staff member or any physicians
    • Physician's assistants, nurses or midwives can also receive the infant.
    • Emergency medical technicians are also applicable to receive the infant.

  • Responsibilities of the safe haven provider : Statute : - § [39-8202]

    • Should do every action which is necessary for child's safety and health.
    • Should inform some peace officer.
    • Taking custody of the child on temporary basis.

  • Protection for relinquishing parent : Statute: - § - § [39-8203]: [39-8206]
    • It is not necessary for parents to expose their identity.
    • All the information given by parents will b kept secret.
    • Immunity for rejection and neglect is provided.

    • The child will be moved to the future home as early as possible.

    • After 30 days, a formal request will be made for the termination of parental rights.

    • The parent may file a claim of parental rights to the child, before an order of terminating parental rights.
