State haven laws for Infants

    • Child should not be more than one week old.

    • Mother.

  • Who may receive the infant : Statute : Statute: - §- § 19-10A-2; 19-10A-4
    • Employees, agents, or members of staff of any medical facility, including:
      1. Any infirmary
      2. Any birth center
      3. Any health center
      4. Any hospital
      5. It don't include private offices of dentists or physicians.

  • Responsibilities of the safe haven provider : Statute : Statute: - § 19-10A-6
    • Notify to the 'Department of Human Resources'.
    • Accept the child for the inpatient admission.

  • Immunity for provider : Statute: - § 19-10A-7 Yes.

  • Protection for relinquishing parent : Statute: Statute: - § 19-10A-4
    • The mother should provide her identity proof and name and address to person accepting her child.
    • Mother shall not be prosecuted for cruelty to a child and shall not contributed to the deprivation of child, or abandonment, and the child is not more than one week old.

  • Effect on the parental rights : Statute : - § 19-10A-6
    • The department has to bring a child before the juvenile court to determine placement, as per - § 15-11-47.
    • Within six hours, the department have to take physical custody of the child.
