• About adoption consent
  • The father, if the child was conceived or born while he has established paternity or he was married to the mother of that child

• Age required of an adoptee to consent of adoptee : Statute: - § 63.062(1)(c)

  • A child of age 12 years or more than that should provide a written consent to the adoption unless the court finds it in the child's best interest to waive consent.

• No need of parental consent: Statute: - § 63.089
  • Child's parent is mentally incompetent.
  • The parent has abandoned the child.
  • A custodian or guardian is correct one to withhold consent unreasonably.
  • After the termination of the parental rights.

• Execution of consent: Statute: - §- § 63.062; 63.088
  • Consent will be implied if the identity or the location of the person whose consent is required, but it's unknown, and person has been served with constructive notice like published in the newspaper of the county of last known residence, etc.
  • Birth mother within 48 hours after the minor's birth can execute the written consent.
  • At any time after the birth of the child, father may execute consent.

• Consent execution is must: Statute: - § 63.082
  • In the presence of 2 witnesses, acknowledged by a notary public, parents may execute consent in case of direct placements.
  • In the agency adoption, consent is by affidavit and only from an authorized representative.

• Consent revocation : Statute: - § 63.082

  • Consent to the adoption of a minor of the age more than 6 months may be revoked in 3 days or anytime prior to the placement, which one of it is later, unless and until that consent was obtained by fraud or duress.

  • Consent to the adoption of minor who is to be placed with identified prospective parents, as per the - § 63.052, can be withdrawn, if the court finds that the consent was obtained by fraud or duress only.
