About adoption consent

  • For whom it is must to consent to adoption : Statute: - § 45a-724
    1. An unmarried mother, after receiving notice by the putative father about rights termination.
    2. A surviving parent after the death of other parent
    3. The child's guardian
    4. Any statutory parent

  • Age required of an adoptee to consent of adoptee: Statute: - § 45a-724

    A child of age 12 years or older must consent to the adoption.

  • No need of parental consent: Statute: - § 45a-717(f)-(g)

    When Parent has:

    1. Caused the child non-accidental injury
    2. Failed to continue relationship with the child for at least a year
    3. Abandoned the child
    4. Had rights terminated
    5. Killed other child of the parent or was convicted of sexual assault resulting in the conception of a child

  • Execution of consent: Statute: - § 45a-715(d)

    The mother can not consent within the 48 hours after the child's birth.

  • Consent execution is must: Statute: - § 45a-715(d), (f)
    1. A guardian ad litem approve relinquishment by a minor parent.
    2. A court approve the petition for voluntary relinquishment.

  • Consent revocation: Statute: - § 45a-719
    1. The court will give priority to the child's best interests.
    2. Petition to set aside termination may be filed prior to final decree.
