About adoption consent

  • For whom it is must to consent to adoption : Statute: - §- § 19-5-203

    A written and verified consent is required from followings:

    1. The child parents
    2. A parent in stepparent adoption.
    3. If parents are deceased then a guardian of a child

  • Age required of an adoptee to consent of adoptee: Statute: - § 19-5-103; 19-5-203

    Written consent is must for any child of age 12 years or more and children must undergo counseling.

  • No need of parental consent: Statute: - §- § 19-5-203; 19-3-604
    1. Parental rights have been terminated may be because of the parent's unfitness.
    2. If for a year parent failed to provide support or abandoned the child.

  • Execution of consent: Statute: - §- § 19-5-104; 19-5-203
    1. Any time after the birth of the child consent may be executed.

  • Consent execution is must: Statute: - § 19-5-103
    1. The parent must petition the court after obtaining a counseling from the Department of Social Services.

  • Consent revocation: Statute: - § 19-5-104(7)(a)
    1. Consent may revoke, if after the entry of the order within 90 days and if it is established clearly and convincingly with evidence that the consent was obtained by fraud or duress.
