About adoption consent

  • For whom it is must to consent to adoption : Statute: - § 9-9-206
    1. A person or agency lawfully entitled to custody
    2. The mother
    3. The court
    4. Spouse of the adopted minor
    5. Father, in case married to the mother of a child or if has established paternity

  • Age requirements of the adoptee to consent : Statute: - § 9-9-206

    A child of age 10 years or more than it have to consent for the adoption in open court.

  • No need of parental consent: Statute: - § 9-9-207

    1. A parent has had his or her parental rights terminated.
    2. The person to be adopted is an adult.
    3. A parent has deserted the child
    4. A legal guardian fails to respond to a request for consent for 60 days, or has been found to be withholding consent unreasonably.
    5. A parent has failed to communicate or provide for the care or support of the child for at least 1 year

  • Execution of consent: Statute: - § 9-9-208

    A consent can be executed at any time after child birth.

  • Consent execution is must: Statute: - § 9-9-208
    1. If the parent is a minor, the guardian ad litem must sign the consent.
    2. If child is not old enough to grant consent and in the presence of a judge only.
    3. It is must to executed the consent in the presence of a judge.

  • Consent revocation: Statute: - § 9-9-209
    1. A consent for adoption in 10 days after it is signed or the child is born, may be withdrawn.
