About adoption consent
- For whom it is must to consent to adoption : Statute: - § 8-106(A), (B)
- The birth or adoptive mother
- Father
- Minority of the parent does not affect competency to consent.
- Has otherwise established paternity
- Any guardian of the child or agency that has been given the child to place for adoption
- If he was married to the mother at the time of conception
- The guardian of an adult parent, if one has been appointed
- Is the adoptive father
- Age required of an adoptee to consent of adoptee : Statute: - § 8-106(A)
A child of age 12 years or more than that should consent to the adoption in open court.
- No need of parental consent : Statute: - §- § 8-106(B);8-106.01(E)
- Adult parent has had a guardian appointed.
- A putative father who does not file claim of paternity waives right of notice.
- A parent has previously consented that an agency place the child.
- A parent has had his or her parental rights terminated.
- Execution of consent : Statute: - § 8-107(B)
A consent is invalid, if given sooner than 72 hours after the birth of the child.

The consent which is given in writing, witnessed by more than two credible witnesses, and acknowledged before a notary public.
- Consent revocation : Statute: - § 8-106(D)
Consent is irrevocable unless and until it is obtained by duress, fraud, or undue influence.
