About adoption consent
- For whom it is must to consent to adoption : Statute: - § 25.23.040
- Mother
- The spouse of a minor
- The father by adoption, or otherwise legitimized
- The father if married to the mother
- The court
- Any person lawfully entitled to custody or consent
- Age required of an adoptee to consent of adoptee : Statute: - § 25.23.040
- An adult to be adopted must consent.
- 10 years child or more older are suppose to consent to the adoption, unless the court in the child's best interest dispenses with consent.
- No need of parental consent : Statute: - § 25.23.050
If parent has:
- Abandoned the child
- Been declared incompetent
- Had rights terminated
- The child is 19 years of age or older
- Failed to communicate with or support the child
- Execution of consent : Statute: - § 25.23.060
Any time after the birth of the child
- Consent execution is must : Statute: - §25.23.060
- Before any person who is authorized to take acknowledgments
- Before the court
- Consent revocation : Statute: - §25.23.070
- Consent to adoption can not be withdrawn after the entry of a decree of adoption.
- After 10 days, the court must find withdrawal of consent to be in the child's best interest.
- Consent can be withdrawn before the entry of the adoption decree for any reason within 10 days of executing consent.
