Adoption expenses regulation
Expenses allowed for birth parent : Statute: - § 26-10A-34(a)
- As an act of charity, maternity-connected hospital or medical and necessary living expenses of pregnancy-related incapacity and the mother preceding.
Expenses allowed for adoption arrangement : Statute: - §- § 26-10A-23(a); 26-10A-34(b)
- For bringing the adopting parent together with natural parents or adoptee or for assisting, placing, or arranging a minor placement, a fee may not be accepted by any person or the other entity.
Expenses allowed for child relinquishment : Statute: - §- § 26-10A-23(d); 26-10A-34
- The parents surrendering the child and the adoptive parents must provide evidence for no money or other things of value have been received or paid for surrendering the adoption of a child.
Fees allowed for charges by agency or department : Statute: - § 26.10-4.1
- If the parental rights for the child were terminated, who was placed for adoption under to the courts order. In this case, the Department should not collect money, but they shall collect $300 in the cases involving adoption for investigation services as a fee charges.
- For good cause the Department may give up this fee.
Expenses accounting as per court requirement : Statute:- § 26-10A-23(b)-(c)
- Court must approve all payments made.
- Petitioners must file a pledged statement that is a full accounting of all charges, expenses and fees to be paid.
