Putative fathers
The State must have a Putative Father Registry.
Registry requirements to receive notice : Statute: - § 26-10C-1
- The putative father may file within 30 days after the birth of a child or prior to the child's birth.
- A completed form of Department of Human Resource is signed by the putative father and notarized for the registration.
Information in the registry or claim : Statute: - § 26-10C-1(a)
- Name, date of birth, social security number, and address of the following:
- Any person must be a father of the child who is adjudicated by the court of this state or another state.
- A person who has filled the registry after or before the child's birth, should get a notice of intent claim paternity of the child.
- Any person who has filed with the registry an instrument acknowledging paternity pursuant to - §- § 26-11-1 to 26-11-3
Revocation of claim to paternity : Statute: - § 26-10C-1(d)
- To claim paternity, the putative father may revoke a notice of intent at any time.
Who may access to registry information : Statute: - § 26-10C-1(f)
- Any court upon request
- The court handling the adoption
- Any person upon a court order for good cause
