Adoption parties

Who can adopt : Statute: - § 26-10A-5

  • Any adult person or husband and wife jointly who are adults, with the following stipulations:
    1. An adoption by a single person should not be prevented entirely by any regulation because the person is unmarried.
    2. An adoption should not be prevented entirely by any regulation because of the person's age.
    3. An adoption should not be prevented entirely by any regulation because the adult person is employed outside the home.

Who can be adopted : Statute: - § 26-10A-6

  • A minor
  • An adult who is:
    1. Mentally retarded
    2. Permanently and totally disabled

Who can place a child for adoption : Statute: - § 26-10A-33

  • A parent
  • A relative of a degree of relationship specified in statute
  • A parent of a deceased parent
  • Department of Human Resources
  • An agency approved by the Department
  • A licensed child-placing agency
